Companies House Webfiling - GDPR Compliance – March 2018

As part of preparations for the implementation of the General Data Protection Regulation (GDPR) in May 2018, Companies House have reviewed the “3 from 7” personal data used to authenticate subscribers in e-filed company mortgage/charge registrations, in relation to the Deed Certification Statement section of mortgage charge eSubmissions. Companies House have decided that to remove “eye colour” from their authentication options due to the fact that, under the GDPR, biometric data is categorised as ‘special category’ data and therefore subject to stricter controls.

 

The following eSubmission forms have been amended to remove the “eye colour” option to prevent accidental use once GDPR comes into force.

  • MR01 – Particulars of a charge
  • MR02 – Particulars of a charge subject to which property or undertaking has been acquired
  • LL MR01 – Particulars of a charge created by a Limited Liability Partnership (LLP)
  • LL MR02 - Particulars of a charge subject to which property or undertaking has been acquired by a Limited Liability Partnership (LLP)

In addition to these changes we have taken the opportunity to amend field notes to clarify the brief description procedure, to match our separate guidance notes advice, and include further validation controls.

Companies House plan to remove this “3 from 7” “eye colour” personal data authentication category by 25th May 2018.
