There are separate forms for companies registered in England & Wales and those registered in Scotland and registered in Northern Ireland.
The new forms are:-
- IE01 – Notice of approval of an undertaking by an office-holder in respect of assets in another member State
- IE01(Scot) for companies registered in Scotland
- IE01(NI) for companies registered in Northern Ireland
For use when the main Insolvency proceedings are in the UK and the office holder is giving an undertaking to creditors in another Member State to avoid proceedings being opened there.
- IE02 – Notice of approval of an undertaking proposed by the member State liquidator to local creditors in the UK
- IE02(Scot) for companies registered in Scotland
- IE02(NI) for companies registered in Northern Ireland
For use when the main Insolvency proceedings are in another Member State (not UK) and the office holder is giving an undertaking to creditors in the UK to avoid proceedings being opened in the UK.
- IE03 – Notice of an order opening group co-ordination proceedings
- E03(Scot) for companies registered in Scotland
- IE03(NI) for companies registered in Northern Ireland
For use to deliver a notice stating there are other insolvency proceedings in respect of the company open in another Member State and they are subject to a group co-ordination order.
- IE04 – Statement of insolvency proceedings in another Member State with consent to dissolution
- IE04(Scot) for companies registered in Scotland
- IE04(NI) for companies registered in Northern Ireland
For use to notify Companies House when insolvency proceedings are concluded in the UK and consent has been given by all other Member State liquidators for the dissolution of the company.
These new forms may be used immediately.
